In Poland, amendments were made to the law on Ukrainian refugees: what are the changes regarding entry and stay?

The Embassy of Ukraine in Poland reports that on June 30, 2022, President Andrzej Duda signed amendments to the Law "On Assistance to Citizens of Ukraine in connection with the Armed Conflict on the Territory of Ukraine" and some other laws. The main changes regulate the conditions for granting temporary protection on the territory of the country, entry, stay, employment, and residence of Ukrainians.


In particular, in the part that directly concerns the conditions for Ukrainian refugees, the changes include the following:


✅ new regulations regarding the PESEL UKR register (PESEL-universal electronic population registration system).


Previously, this status, which granted temporary protection rights in Poland, was automatically lost after a person left the country for more than 30 days. According to the new rules, if this status is automatically lost after the departure of a military migrant for longer than 30 days, but within the Schengen zone, it can be restored. UKR status can also be renewed if a person returns to Poland after leaving for Ukraine for more than 30 days. The reason for the return must be justified - it is active hostilities at the place of residence.


✅Changes have been made to the provision on the need to enter Poland directly from the territory of Ukraine in order to have the right to temporary protection in the country. From July 1, 2022, entry to Poland can also take place through the internal borders of the EU - persons entering Poland from the EU will also be able to claim the rights of military refugees.


✅Changes have been made to the rule according to which hosts who sheltered displaced persons were paid monetary assistance in the amount of 40 zlotys for accommodation and food. A rule has been introduced according to which an application for receiving financial assistance is submitted within one month from the last day of the period for which the application is submitted. Applications submitted after the deadline will not be considered.


We would like to remind you that from July 1, assistance to Ukrainian refugees' hosts will be issued only to for most vulnerable categories.


✅ The changes also introduce a number of comprehensive solutions aimed at creating more flexible conditions in the labor market for Ukrainians, increasing opportunities to enroll in Polish language courses, as well as creating new childcare centers for children from Ukraine and additional places in kindergartens.
