Money for job vacancies: Ukrainians were exempted from paying for employment services abroad

The government of Ukraine amended the law "On employment of the population" and prohibited companies that help Ukrainians to look for work abroad from charging potential workers for their services. The changes are already in effect from October 26, 2022. The employer, for whom the agency recruits personnel, was obliged to pay for the intermediary's work. The relevant information was published by the Ministry of Economy of Ukraine.
That is, from now on, services for which intermediaries used to charge quite a lot of money became free for Ukrainians:
• the intermediary must advise you and provide all information about the benefits of legal employment in European countries;
• tell about the nature of the future work and your duties;
• tell in detail about the salary, the system of its calculation and payment;
• introduce living conditions: whether housing is provided, its location and level of comfort;
• tell whether there are any international documents concluded between Ukraine and the state of employment that guarantee your rights during work.
Attention! The Company is prohibited from taking any money from you (fees, commissions, rewards, etc.).
What do lawyers say?
If an intermediary who helps you find a job requires money from you, we advise you to draw his attention to the changes in Part 2 of Article 38 of the Law of Ukraine "On Employment of the Population", the new edition:
"2. An economic entity that provides mediation services in employment abroad is obliged to provide citizens of Ukraine free of charge with consultations and information about the advantages of legal employment abroad, the nature of future work, conditions and amount of remuneration, conditions of residence in the host country, availability of international contracts (agreements) in the field of employment and social security concluded between Ukraine and the state of employment.
Business entities that provide employment mediation services abroad are prohibited from receiving fees, commissions, and other rewards from citizens who have provided these services. Payment for mediation services in employment abroad is carried out by the employer to whom such services were provided."
