A temporary residence permit in Ukraine may be a residence permit issued on the basis of family reunification. A person who has obtained a residence permit may stay in the country for a period exceeding the validity of a visa or the period of visa-free regime. In this case, the foreigner will be able to come to the country whenever he or she wishes and stay as long as necessary.

After obtaining a residence permit on the basis of family reunification with an expatriate, a foreigner does not need to obtain a visa to cross the border during the period of validity of the residence permit. Also, when crossing the border, the procedure will be somewhat simplified than for persons who arrived with an open visa.


Who can apply for a residence permit on the basis of family reunification?


A temporary residence permit on the basis of family reunification is issued to:

1) to the husband or wife;

2) minor children

3) incapacitated parents.


How to apply for a residence permit?


Documents for a residence permit must be submitted no later than 25 days before the expiration of the visa (15 working days). They must be submitted to the Migration Service of Ukraine in person. If the documents are submitted and executed correctly, the residence permit is issued within 15 working days from the date of acceptance of the application.


Documents required


To apply for a residence permit on the basis of family reunification, you must have

– original passport document;

– health insurance policy;

– documents confirming kinship with the family member who has a temporary residence permit;

– a document confirming that the host person has sufficient material resources to support family members;

– a temporary residence permit of the person to whom the person is going to visit.


Please note! For foreigners and stateless persons who come from countries with a visa-based entry procedure, a long-term type D visa is required.

Who can be denied the service and for what reasons?


The list of reasons for refusing to provide an administrative service is available on the diia.gov.ua portal. Thus, a foreigner may be denied a residence permit if:


1) the foreigner or stateless person has a permanent residence permit, refugee certificate or certificate of a person granted complementary protection, which are valid on the day of application;

2) the foreigner or stateless person is staying on the territory of Ukraine in violation of the established period of stay

3) the data obtained from the Register's databases and files do not confirm the information provided by the foreigner or stateless person;

4) the person's citizenship of Ukraine has been established;

5) a legal representative who does not have documented authority to obtain the certificate has applied for it;

6) the foreigner or stateless person has not submitted all the documents required for the issuance of a residence permit in full or in violation of the terms;

7) the person poses a threat to national security, public order, health, protection of the rights and legitimate interests of Ukrainian citizens and other persons residing in Ukraine;

8) the foreigner's passport or stateless person's document is forged, damaged or does not comply with the established standard, or belongs to another person, or its validity has expired;

9) the fact of knowingly submitting false information or forged documents by a foreigner or stateless person has been established;

11) in other cases provided for by law.


It should be noted that a decision to refuse to issue a document may be appealed by a person in an administrative procedure or in court.
